1. Acceptance of Terms
By accessing or using DoctorNoted ("the Service"), operated by DoctorNoted Inc. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
DoctorNoted is a documentation platform that helps users prepare a Letter of Medical Necessity (LMN) packet for review and signature by their own licensed primary care physician. We do not provide medical advice, diagnosis, treatment, or determine medical necessity. All clinical decisions remain with the user's own physician.
3. Eligibility
You must be 18 or older and a U.S. resident to use the Service. By using DoctorNoted, you represent that you meet these requirements.
4. User Responsibilities
You agree to provide accurate, current, and complete information during the intake process. You acknowledge that DoctorNoted does not verify the accuracy of the information you provide and that providing false information may result in denial of reimbursement, account termination, or legal liability.
5. Not Medical or Legal Advice
The Service does not provide medical, legal, or tax advice. Information presented is for general educational purposes. Consult your physician for medical decisions, your tax advisor for tax decisions, and legal counsel for legal advice. Reimbursement from FSA/HSA accounts is not guaranteed and depends on your administrator's review of submitted documentation.
6. Fees and Payment
Service fees are due at the time of intake submission. All fees are stated on the pricing page and are non-refundable except as expressly provided in our refund policy or required by law.
7. Privacy
Your use of the Service is also governed by our Privacy Policy and HIPAA Notice.
8. Intellectual Property
All content on the Service, including templates, summaries, and software, is the property of DoctorNoted or its licensors and is protected by copyright and other intellectual property laws.
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will achieve any specific outcome including approval of FSA/HSA reimbursement.
10. Limitation of Liability
To the maximum extent permitted by law, DoctorNoted shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the fees you paid us in the preceding 12 months.
11. Indemnification
You agree to indemnify and hold harmless DoctorNoted, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your violation of these Terms or misuse of the Service.
12. Modification of Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
